Writ petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to grant appropriate permission to conduct peaceful procession at Kalmedu Village, Aandar Kottaram Panchayat, Madurai District on 19.06.2018 between 06.00 pm to 10.00 pm by RMPI party headed by the petitioner.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to grant appropriate permission to conduct peaceful procession at Kalmedu Village, Aandar Kottaram Panchayat, Madurai District on 19.06.2018 between 06.00 pm to 10.00 pm by RMPI party headed by the petitioner.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Advocate General appearing for the respondents. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself. 3.According to the petitioner, notice has been issued for conducting procession at Kalmedu Village, Aandar Kottaram Panchayat, Madurai District and also he made arrangements for the said procession. But, without any intimation, the respondent police has informed the petitioner to stop the procession. Hence, https://hcservices.ecourts.gov.in/hcservices/

the present writ petition has been filed with the aforesaid prayer.

4.The learned Additional Advocate General appearing for the respondents would submit that the petitioner has not made any application to the respondents, seeking permission to conduct procession. They only placed materials to make arrangements only for light and sound in the venue place. Therefore, this writ petition is not maintainable.

5.Considering the fact that the petitioner has not filed any application before the second respondent, seeking permission for conducting procession, this writ petition is liable to be dismissed. Accordingly, Writ Petition is dismissed. However, it is for the petitioner to make an application before the concerned authorities, seeking permission for conducting procession. No costs.
