ORDER

The prayer in the writ petition is for a mandamus directing the respondents not to register any further alienation of the properties situated in Survey Nos.421/5, 149/5A, 161/7, 169/3, 160/3, 167/21, 160/8, 161/6, 162/18 and 348/2 situated at Thirupathur Sivagangai District, till the disposal of O.S.No.29 of 2021, pending before the District Court, Sivagangai, by considering the petitioner's representation dated 28.02.2026. 2.Upon hearing the learned counsel for the petitioner and perusing the material records of the case, it can be seen that in respect of the dispute regarding the said properties, the above suit has been filed. Now pending the suit, the present writ petition is filed. 3.M/s.K.Malathi, learned Additional Government Pleader takes notice on behalf of the respondents.

4.It is no more res integra that for a mere pendency of the suit, the registering the authority cannot refuse to register the document. The petitioner does not want the defendants to alienate, it will be open for the petitioner to move a proper interlocutory application in the same suit. The learned counsel for the petitioner submits that as a matter of fact the said IA

has been filed, but the same is yet to be numbered and taken on file. 5.In view thereof, this writ petition is disposed of on the following terms:

(i)The prayer made in the writ petition cannot be granted. However, it will be open for the petitioner to file such an interlocutory application in the suit in O.S.No.29 of 2021 pending before the District Court, Sivagangai, and, as and when such interlocutory application is made, the same shall be taken up and disposed of as expeditiously by the learnerd District Judge, Sivagangai. No costs.
