Respondent/Defendant Prayer: This Civil Revision Petition is filed under Article 227 of Constitution of India to allow the above Civil Revision Petition by directing the court below to number the suit in O.S.SR.No.437 of 2017 on the file of the learned District Munsif Court, Sencottai, Tirunelveli District.

ORDER

When the matter is taken up for hearing, the learned counsel for the revision petitioner seeks leave of this Court to withdraw this petition with liberty to represent the plaint before the appropriate Court. He has also made an endorsement to that effect.

2. Considering the nature of the grievance expressed by the revision petitioner, this Court is of the opinion that the revision petitioner shall represent his plaint after compliance of the defects pointed out by the Trial Court and on such resubmission, the Trial Court can pass appropriate orders regarding the admissibility of the suit.

3. With the above observations, this Civil Revision Petition is dismissed as withdrawn with liberty to the petitioner to work out his remedy in the manner known to law. No Costs.

4. The Registry is directed to return back the original plaint presented before this Court to the learned counsel for the revision petitioner.
