ORDER
The writ petition challenges the impugned refusal check slip. When the petitioner presented a settlement deed for registration, the same was refused on the ground that the original document was not produced.
2. According to the learned counsel for the petitioner, the property was purchased by the petitioner's father. The petitioner's father, as well as her brother, are no more, and the petitioner is the sole surviving legal heir. The original deed is not traceable.
3. In view of Section 34-C of the Registration Act, where the original document is available, unless it is produced, the first respondent is justified in issuing the impugned refusal check slip.
4. However, the case of the petitioner is that the original document is missing and not traceable. In such circumstances, the petitioner shall approach the jurisdictional Police. Upon receipt of the complaint, the jurisdictional Police shall deal with the same in accordance with law and the relevant circulars issued in this
regard. If the document cannot be traced, a non-traceable certificate shall be issued as expeditiously as possible by the jurisdictional Police. Thereafter, it will be open to the petitioner to re-present the document, upon which the same shall be registered.
