PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents 2 to 5 to take immediate action to recover all the Antique Jewels and other Priceless things belonged to the 12 God Idols Temple (Panirendappar Kovil), Palamputhur, Kookkal Village, Kodaikanal, Dindigul District by initiate appropriate enquiry within a period that may be stipulated by this Court.

When the matter was taken up for hearing, Mr.M.Karunanithi, learned Government Advocate, appearing for the fifth and sixth respondents brings to my notice that the sixth respondent after perusal of the complaint has come to a conclusion that the dispute raised in the complaint is one of civil in nature and that, parties have to work out their rights before the jurisdictional civil Court. 2/5

2. Mr.N.Mohan appearing for the petitioner seeks permission of this Court to withdraw the above writ petition with liberty to approach the jurisdictional civil Court seeking return of articles, which are in the hands of the seventh respondent and which the petitioner claims belongs to the Panirendappan temple. He has also made an endorsement to that effect.
