The Branch Manager, Canara Bank, Thapal Thanthi Nagar Branch, No.53, Old Natham Road, Madurai - 14 : Respondent Prayer: This Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondent to provide Rs.3,89,100/- (Rupees Three Lakhs Eighty Nine Thousand and one Hundred only) as Education Loan to the petitioner for Bachelor of Engineering (B.E.,) Electrical and Electronic Course within the time stipulated by this Court. O R D E R

The petitioner seeks for Mandamus directing the respondent to provide a sum of Rs.3,89,100/- as Educational Loan for pursuing her Bachelor Degree in Engineering.

2. The grievance of the petitioner is that, even though the petitioner applied for such Educational Loan and satisfied the respondent Bank with all required documents, the request of the petitioner has not been considered. Therefore, the present Writ Petition is filed for the relief as stated supra.

3. The learned counsel appearing for the respondent Bank, on instructions, submitted that the petitioner's application was not considered only on the reason that the petitioner's brother who availed Educational loan has not repaid the same in time and however, settled the loan amount later, by making one time settlement.

4. Upon hearing the learned counsel appearing on either side, this Court is of the view that the respondent Bank is not justified in refusing to consider the petitioner's application https://hcservices.ecourts.gov.in/hcservices/

seeking for Educational loan, as her brother belatedly settled his Educational loan amount, that too not availed from the respondent Bank. In any case, as admitted by the learned counsel appearing for the Bank, the brother of the petitioner has subsequently paid entire loan amount making one time settlement with that Bank and therefore, there cannot be any impediment for the respondent Bank for considering the application of the petitioner for providing Educational loan to her.

5. Therefore, the Writ Petition is disposed of with a direction to the respondent Bank to consider the application submitted by the petitioner, seeking for Educational loan and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No costs.
