PRAYER :- For Anticipatory Bail in Crime No.470 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with the case in Crime No.470 of 2023, for the offence under Sections 454, 457 and 380 IPC, has filed this petition seeking anticipatory bail. 1/3

2. The case of the prosecution is that the petitioner broke open the TASMAC shop and took away the liquor bottles worth about Rs.1,10,000/- from the shop. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4. The learned Additional Public Prosecutor appearing for the respondent Police opposes for grant of anticipatory bail on the ground that the investigation is yet to be completed and the alleged amount of Rs.1,10,000/- is to be recovered from the petitioner.

5. Considering the nature of allegations and also considering the fact that the alleged amount of Rs.1,10,000/- is yet to be recovered from the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
