PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the 3rd respondent herein dated 21.03.2025 and quash the same as illegal and arbitrary consequently direct the 1 to 3rd respondents herein to grant permission and police protection to the petitioner to conduct the temple festival will be schedule on 30.03.2025 to 01.04.2025 to the Sri Arulmigu Vinayagar, Sri Kaliamman, Sri Maraiamman, Sri Muniyandi and Sri Karuppanasamy Temple are situated at S.Paraipatti, Singarakottai Village, Vedasandur Taluk, Dindigul District based on the petitioner's representation dated 17.03.2025.

O R D E R

This Writ Petition has been filed seeking a direction to quash the impugned order passed by the third respondent herein dated 21.03.2025 and consequently direct the respondents 1 to 3 herein to grant permission 2/7

and police protection to the petitioner to conduct the temple festival will be scheduled on 30.03.2025 to 01.04.2025 to the Sri Arulmigu Vinayagar, Sri Kaliamman, Sri Maraiamman, Sri Muniyandi and Sri Karuppanasamy Temple are situated at S.Paraipatti, Singarakottai Village, Vedasandur Taluk, Dindigul District, based on the petitioner's representation dated 17.03.2025.

2.According to the petitioner, he is the Poosari of the said temple and the villagers decided to conduct festival from 30.03.2025 to 01.04.2025 and the villagers have decided to conduct cultural programme on 31.03.2025, thereby, the petitioner sent the representation dated 17.03.2025 to the respondents 1 to 3, but the same has not been considered. Hence this petition.

3.The learned Government Advocate appearing for the first respondent would submit that there are two rival groups claiming rights over the temple and decided to conduct the festival separately. Therefore, the authorities concerned have decided to conduct a peace committee meeting today. In the mean time, petitioner filed this petition. However, since the programme is scheduled to be held on 31.03.2025, if 3/7

the petitioner undertakes to conduct the festival without any law and order issue, they have no objection.

The learned Additional Public Prosecutor appearing for the respondent police would submit that there is a dispute between two groups in respect of conducting festival and thereby, the matter was referred to the first respondent for conducting peace committee meeting and the date of the meeting is fixed today. Therefore, subject to the outcome of the peace committee meeting, the respondent police will take appropriate decision.

5.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondents, is inclined to pass order.

6.According to the petitioner, the villagers decided to conduct the festival from 30.03.2025 to 01.04.2025 and they decided the conduct cultural programme on 31.03.2025. Therefore, the petitioner has approached the respondents 1 to 3 for permission and police protection but they have not considered the request. According to the respondents 4/7

1 to 3, there is a dispute between the parties in respect of conducting the festival, thereby, today they convened the peace committee meeting. 7.Since the cultural programme is scheduled to be held on 31.03.2025 and the time is also too short, though the peace committee meeting is fixed today, without affecting the rights of the parties in conducting the festival, this Court is inclined to direct the respondents to consider the petitioner's representation in respect of conducting cultural programme positively and also provide adequate police protection for the said programme on 31.03.2025. If any rival party want to conduct the programme on alternative date, the same can also be considered by the official respondents.

8.With the above direction, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. 28.03.2025 Internet :Yes Index :Yes/No NCC :Yes/No LR 5/7
