O R D E R

Seeking a direction to the respondent police to complete the investigation and to file a final report in Crime No.8 of 2016 before the concerned forum, the petitioner has come up with this petition.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. According to the petitioner, the petitioner made a complaint to the respondent police against the proposed accused and the case was registered in Crime No.8 of 2016 for the offences punishable under Sections 406, 419 and 420 of IPC. He further submitted that though the FIR was registered in the year 2016, the respondent police has not yet filed the charge sheet. Hence, the present petition has been filed before this Court.

The learned Additional Public Prosecutor on instructions, would submit that the respondent police need the signature of the petitioner for sending the same to the handwriting expert for comparison. Hence, they served summons to the petitioner. But, after receiving the summons, the petitioner did not furnish his signature before the respondent police and did not cooperate for enquiry. Therefore, the respondent police is not able to complete the enquiry and file the final report before the Court concerned. He further https://hcservices.ecourts.gov.in/hcservices/

submitted that if the petitioner cooperates for enquiry and produce his signature, the enquiry will be completed as early as possible.

5. At this juncture, the learned counsel for the petitioner undertakes that the petitioner will cooperate with the respondent police to complete the enquiry.

6. In the light of the above, the petitioner is directed to appear before the respondent police and furnish his signature within a period of two weeks from the date of receipt of a copy of this order. If the petitioner complies the above said direction, the respondent police shall complete the investigation and file the final report within a period of four weeks thereafter.

7. With the above direction, the Criminal Original Petition is disposed of.
