PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to issue a direction, directing the 1st respondent herein to transfer the investigation in crime no.51 of 2022 from the file of 2nd respondent to any other investigating officer for free and fair investigation in the light of petitioner's representation dated 21.03.2022.

ORDER

This petition has been filed seeking direction to direct the first respondent herein to transfer the investigation in Crime no.51 of 2022 from the file of 2nd respondent to any other investigating officer for free and fair investigation in the light of petitioner's representation dated 21.03.2022.

2. The learned Additional Public Prosecutor would submit that after registration of the First Information Report, the second respondent conducted investigation and they have also examined some of the witnesses.

3. Under such circumstances, if the investigation is transferred from the file of the second respondent to any other independent agency, it would affect the entire investigation done by the second respondent.

4. In view of the same, the second respondent is directed to complete the investigation and file the final report before the concerned Court within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, the Criminal Original Petition stands disposed of.
