This Writ Petition has been filed seeking a writ of mandamus directing the second respondent to consider the petitioner's representation, dated 21.06.2024 with regard to transferring the petitioner from the fourth respondent society to the parent society i.e the third respondent society within the time stipulated by this Court.
2. The petitioner was originally appointed as Junior Assistant in the third respondent society in the year 1987. The second respondent by proceedings, dated 15.03.2023 transferred him to the fourth respondent society. He joined in the fourth respondent society on 16.03.2024. The petitioner is going to retire on 31.07.2025. The petitioner submitted a representation to the respondents 1 and 2 on 21.06.2024 to transfer him back to the third respondent society. The second respondent vide letter, dated 06.11.2024 informed the petitioner that his request 2/5
is under consideration. But so far no steps have been taken. Against the inaction of the respondents in considering his request, he approached this Court by filing this writ petition.
3. Admittedly, there are no specific allegations against the petitioner. Under these circumstances, the second respondent is the competent authority to consider the request of the petitioner to enable him to retire on his parent society i.e, third respondent society as on the date of his retirement in the interest of the petitioner.
4. Considering the facts and circumstances of the case, this Court intends to dispose of this writ petition at the stage of admission with the consent of both parties without going into the merits of the case with a direction to the second respondent to consider and pass orders on the representation, dated 21.06.2024 submitted by the petitioner to transfer him back to the third respondent society forthwith to meet the ends of justice.
5. Accordingly, this writ petition is disposed of with a direction to the second respondent to consider and pass appropriate orders on the 3/5
representation, dated 21.06.2024 submitted by the petitioner to transfer him back to the third respondent society forthwith. No costs.
