C-51Q. To pass an order to call for the records of the charge sheet in Special Calendar Case No. 101 of 2019 on the file of the Special Court for POCSO Cases, Tirunelveli and quash the same as illegal as against the petitioner.

ORDER

The present petition is filed to quash Special Calendar Case No. 101 of 2019 on the file of the Special Court for POCSO Cases, Tirunelveli.

2.The allegation against the petitioner is under Sections 6 read with 5(i)(II)(1) of POCSO Act, 2012.

3.The petitioner was 35 years old at the time of occurrence and the victim was the 17 years old at the time of occurrence.

4.The contention of the petitioner is that he has not committed the offence. However, the learned Government Advocate (Crl.side) submitted that after the said sexual assault, the victim girl became pregnant and delivered a baby. Further, he submitted that they conducted DNA test and it is proved that the petitioner was the biological father of the baby. 5.Therefore, this court is not inclined to entertain the criminal original petition. Hence, the criminal original petition is dismissed. Consequently, connected miscellaneous petition is closed.
