Writ Petition is filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order issued by the 1st respondent in Letter (D) No.1448 Home(Pol.2) Department dated 14/12/2018, quash the same and further direct the respondents herein to allow the petitioner forthwith to retire on Voluntary Retirement basis w.e.f.20/12/2018 with all retrial and attendant benefits. C O M M O N O R D E R The Learned Additional Advocate General appearing for the respondents has fairly submitted before this Court that the Government has passed a Government Order dated 21.10.2021 in compliance with the order passed by this Court as well as the order passed by the Division Bench of this Court by dropping the disciplinary charges as against the petitioner. A copy of the said order has also been placed before this Court.
2. In view of the Government Order being passed by the respondents, the respondents have complied with the order passed by this Court and thus there is no willful disobedience on the part of the respondents. Even if there is any delay in passing the order by the respondents, it is only bonafide. The respondents have given assurance before this Court that all other retirement benefits will be settled to the petitioner at the earliest, if there is no legal impediment.
3. In view of the aforesaid Government Order having been passed, the contempt petitions are closed.
