ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 25.03.2025 under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying to grant bail.

2. As instructed by this Court, the victim girl was produced in my Chamber by Mrs. K. Usha, Inspector of Police, All Women Police Station, Papanasam, Thanjavur, Mrs. A. Chitra, CWC, and Mrs. Bhuvaneswari. This Court interacted with the victim girl. At that time, Ms.T. Rajaprabha, Stenographer, was present along with the victim girl.

3. Mr.K.Sanjai Gandhi, learned Government Advocate (Criminal Side) appearing for the respondent-Police has produced the entire deposition of P.W.1. This Court has perused the deposition as well as the statement of the victim girl recorded under Section 183 of the BNSS, 2023, it is seen that the victim girl appeared before the trial Court on 17.05.2024 and was examined in chief, and the crossexamination was also completed on the same day. Thereafter, on 25.09.2024, P.W.1 was recalled and further examined. Further the petitioner (Accused) side filed a petition to recall P.W.1 and another one witness and the same was allowed by the trial Court.

Mr.K.Sanjai Gandhi, the learned Government Advocate (Criminal Side) appearing for the respondent-Police, submits that 28 witnesses have been cited as witnesses in this case, out of which 27 witnesses have been examined as P.W.1 to P.W.27. He further submits that the prosecuting agency intends to examine one more witness and the Investigating Officer.

5. At this juncture, Mr.B.Jameel Arasu, learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition. In that effect, he has made an endorsement in the case file and the same is extracted hereunder: "May be permitted to withdraw in case."
