For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For an Anticipatory Bail in the case in O.R.No. 1 of 2020 on the file of the Forest Ranger, Gulf of Mannar Tamilnadu National Park, Thoothukudi.

ORDER : The Court made the following order :- This is the petitioner's third anticipatory bail application. The petitioner/accused No.2 apprehending arrest at the hands of the respondent police for the offences punishable under Sections 9, 51

(1) of Wild Life Protection Act 2002, in O.R.No.1 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with A-1 smuggled with 250kg of sea-cucumber on 22.01.2020. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has nothing to do with the alleged offence.

CRL OP(MD). No.7917 of 2020 4.The learned Government Advocate (Crl. Side) appearing for the State would submit that there are three previous cases are pending against the petitioner in similar offence. He would further submit that the petitioner is a habitual offender in smuggling sea-cucumber to foreign country. A-1 was already arrested and now in judicial custody.

5.In view of the above facts and circumstances of the case and also considering the fact that there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
