PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the first respondent to transfer the investigation in FIR in Crime No.399 of 2021 on the file of the third respondent to any other Deputy Superintendent of Police, in accordance with law within the time stipulated by this Hon'ble Court. ORDER

This petition has been filed seeking direction to direct the first respondent to transfer the investigation in FIR in Crime No.399 of 2021 on the file of the third respondent to any other Deputy Superintendent of Police, in accordance with law within the time stipulated by this Court.

2. This Petition has been filed for transfer of investigation on the ground that after registration of Firs Information Report in Crime No.399 of 2021 for the offences under Sections 147,294(b), 323,506(2) of IPC r/w.Sections 3(1)(r),3(1)(3), 3(1)(va) of SC/ST application the petitioner has made an application to the third respondent to take steps to pay the atrocity fund to the victims.

3. The learned Additional Public Prosecutor would submit that already the first respondent had made an request dated 06.04.2022 to the District Collector, Thoothukudi to pay the atrocity fund to https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.8408 of 2022 the victims and it is pending before the District Collector, Thoothukudi . He would also submit that the investigation is almost completed and the respondent police is about to file the final report.

4. At this stage, if the investigation is transferred to the file of any other investigating agency, it will affect the entire investigation done by the third respondent. However the second respondent is directed to complete the investigation and file the final report before the concerned Court within a period of twelve weeks from the date of receipt of a copy of this order. Further the District Collector is directed to disburse the compensation amount to the victims within a period of two weeks from the date of receipt of a copy of this order.
