Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the respondents-1 & 2 to not to harass the petitioner under the guise of enquiry based on the complaint given by the third respondent.

This Criminal Original Petition has been filed to not to harass the petitioner, based on the complaint lodged by the third respondent, on the file of the second respondent police.

2. The learned Government Advocate (Crl.Side) would submit that initially, enquiry was conducted based on the complaint lodged by the third respondent and the same was closed. Thereafter, second complaint lodged by the third respondent on different set of allegations and the same has been registered in Crime No.159 of 2019 for the offence under Sections 294(B) and 324 of I.P.C., and Section 4 of Women Harassment Act and the same is pending for investigation. Therefore, the earlier complaint lodged by the third respondent was closed.
