Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the 1st and 2nd respondents to file Final Report in Crime no.126 of 2023 on the file of the 2nd Respondent Police before the Judicial Magistrate, Thiruchuli, Virudhunagar District within a stipulated period.

ORDER

This Criminal Original Petition has been filed by the petitioner to direct the 1st and 2nd respondents to file final report in Crime No.126 of 2023 on the file of the 2nd respondent Police before the learned Judicial Magistrate, Thiruchuli, Virudhunagar District within a stipulated period

2. According to the petitioner, he is the defacto complainant in this case and based on his complaint, a case in Crime No.126 of 2023 has been registered for the offences under Sections 120B, 406 and 420 of IPC. Thereafter, no proper investigation has been conducted and so far not filed the final report. Hence, he has filed this petition.

3. The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that already the 2nd respondent has completed the investigation, but so for not filed the final report before the Judicial Magistrate Court, Thiruchuli and they will file the final report within one month.

4. Since the prayer of the petitioner is to complete the investigation and to file the final report, the respondent police have already completed the 2/4

investigation and seeks one month time to file the final report before the Judicial Magistrate Court, Thiruchuli, recording the submission of the learned Government Advocate, this Court directs the 2nd respondent to file the final report within one month from the date of this order.

5. With the above said direction, this Criminal Original Petition is disposed of.
