PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari to call for the entire records, in relating to the impugned order dated 03.03.2026 made in Cr.M.P.No.1243 of 2026 on the file of the learned Chief Judicial Magistrate, Madurai and quash the same.

ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present writ petition seeking to quash the impugned order dated 03.03.2026 made in Cr.M.P. No.1243 of 2026 on the file of the learned Chief Judicial Magistrate, Madurai.
2. When the Court was inclined to dismiss the writ petition, the learned counsel for the petitioner submitted that the amount payable is less than Rs.5,00,000/- and that the petitioner is willing to deposit the same in two instalments on or before 15.04.2026.
3. The learned counsel for the respondents submitted that if the petitioner pays a sum of Rs.4,05,000/- on or before the end of April 2026, the loan account will be regularised and the petitioner will be permitted to continue paying the regular EMI every month.
4. The learned counsel for the petitioner, on instructions, submitted that the petitioner undertakes to deposit the entire amount of Rs.4,05,000/- in instalments on or before 15.04.2026. 2/5
5. Recording the above submissions, this writ petition is disposed of. If the petitioner deposits the aforesaid amount as agreed before this Court within 15th of April 2026, the Bank shall regularise the loan account of the petitioner and permit him to continue payment of the regular EMIs. It is made clear that upon such payment, the Bank shall hand over possession to the petitioner.
6. In the event of default in payment of the said amount within the stipulated time, it is open to the Bank to proceed in accordance with law. No costs. Consequently, the connected miscellaneous petition is closed.
