Writ Petitions are filed under article 226 of the Constitution of India, praying to issue a Writ of Ceriorarified Mandamus, calling for the 2nd respondent in refusal check slip vide No.RFL/Valliyur/13/2026 dated 12.02.2026 and quash the same as illegal, devoid of merits and against the settled principles of law and consequently direct the 2nd respondent to register the settlement deed dated 12.02.2026. ORDER
This writ petition is filed challenging the impugned refusal check slip dated 12.02.2026.
2.According to the petitioner, the aforesaid survey number originally has a larger extent of more than 4 acres and the petitioner and their ancestor, namely Krishna Perumal, are the owners of about 87 cents. The Join patta stands in the name of Krishna Perumal as well as the other owners. After the death of Krishna Perumal, the property devolved on his wife Narayana Vadivu and his two sons Ari Gopal and Ari Lingam. Now the undivided extent of 1/3 each in the said 87 cents is being settled by the wife of Krishna Perumal, namely Narayana Vadivu and the other son, Ari Gopal, in favour of the other son of Krishna Perumal, Ari Lingam. When the said settlement deed is presented for registration, the same was refused to be registered on the grounds that the Patta No.100 also contains other names, without a partition being made, the document is presented. Further the same survey number has been dealt with by third parties also, and several documents are found in the encumbrance.
3.The learned Additional Government Pleader would submit that because there was no clear title that is traced, and there are the documents
by third parties, the refusal check slip came to be issued. 4.I have considered the rival submissions made and perused the material records of the case.
5.When different extents are owned in the same survey number by different persons, it cannot be said that it is joint ownership, especially when no subdivision is made; there will be joint patta also. When it is the claim of the petitioner that 87 cents is the exclusive ownership of Sri Krishna Perumal, the same cannot be rejected on the ground of suspicion. As far as the name of the other persons are concerned since the survey number is a larger extent, there will be the name of the other persons also. 6.In the absence of any objection from any third parties, when the patta being in the name of Krishna Perumal is produced before the Sub Registrar and the three persons, namely the executors and the claimants claiming through said patta and executing the document, in the absence of any specific material to the extent that the petitioner cannot be the executors or they do not have title, etc., merely on presumption or suspicion the refusal check slip cannot be issued.
7.Accordingly, the impugned refusal slip dated 12.02.2026 shall stands quashed, and the petitioner shall re-present the same and the same shall be registered in the manner known to law. The aforesaid exercise shall be completed within a period of four weeks from the date of receipt of web copy of the order. No costs. Consequently, connected miscellaneous petition is closed.
