The charge memo dated 12.09.2015 as well as the order of suspension dated 15.09.2015 issued by the third respondent to the writ petitioner are under challenge in the present writ petition.
2. The third respondent is a Society registered under the provisions of the Tamil Nadu Co-operative Societies Act, 1961 (hereinafter, referred to as "the Act"). The third respondent / Society is not funded by the Government. Thus, the third respondent / Society is neither an instrumentality of the State nor a State as defined under Article 12 of the Constitution of India. Thus, no writ petition can be entertained in view of the legal principles settled in this regard by the Larger Bench of this Court in K.Marappan vs. The Deputy Registrar of Co-operative Societies, Namakkal Circle, Namakkal and another, reported in 2006 (4) CTC 689. https://hcservices.ecourts.gov.in/hcservices/

In respect of the orders passed by the Management of a Co-operative Society, the aggrieved persons are bound to approach the competent authority under the Act for the purpose of redressal of their grievance. The effective statutory alternate remedy is to be exhausted by the aggrieved persons before approaching the competent Court of law. Thus, the writ petitioner has to file a revision petition, under Section 153 of the Act, in the prescribed format and by paying the necessary fees, for the purpose of redressal of her grievance.
4. With these legal principles, the writ petitioner is at liberty to approach the competent authority under the Act. Accordingly, the writ petition is dismissed as not maintainable. No costs.
