When the matter is taken up for hearing, learned Government Advocate (criminal side) submitted that the on the basis of the petition, enquiry was conducted and closed.

2. On a reading of the complaint, it could be seen that it is the case of the petitioner that the opposite party had borrowed Rs.7,00,000/- from him on 18.12.2015 and the opposite party given a cheque of his wife for the said sum drawn at Canara bank, Melur Branch, Thoothukudi, and that when the said cheque was presented, it was returned on the ground that signature is different. Therefore, it appears prima facie materials for the police to conduct enquiry. In such circumstances, this Court directs the respondent police once again to conduct further enquiry on the complaint given by the petitioner and take action in accordance with law.
