Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to exempt the house property in S.No.21/1B to an extent of 1 cent 345 Sq.feet D.No.87, Kannappar Street, Mullainagar, Meenambalpuram Post, Madurai from the purview of the Land Ceiling Act in the light of G.O.Ms.No.565 Revenue Department dated 26.09.2008 as an innocent purchasers based on the petitioner's representation dated 10.05.2024. The Writ Petition has been filed to direct the respondents to exempt the house property in S.No.21/1B to an extent of 1 cent 345 Sq.feet D.No.87, Kannappar Street, Mullainagar, Meenambalpuram Post, Madurai from the purview of the Land Ceiling Act in the light of 2/6

G.O.Ms.No.565 Revenue Department dated 26.09.2008 as an innocent purchasers based on the petitioner's representation dated 10.05.2024.

2. The learned counsel for the petitioner submitted that the petitioner is a bonafide purchaser who was unaware that the land fell within the purview of the Land Ceiling Act. It was further contended that similarly placed persons had been granted relief by the respondents. In this regard, the Chief Secretary (1st respondent) had approved the application of an adjacent landowner and issued a communication to the 2nd respondent in Letter (2D) No. 309 dated 25.02.2026.

3. The learned Additional Government Pleader appearing for the respondents submitted that the competent authority is the 2nd respondent, who must first obtain a report from the 3rd respondent and thereafter consider the matter and pass appropriate orders. 3/6

4. After considering the rival submission, it is noted that the petitioner had already submitted an application in the prescribed format to the 3rd respondent at an earlier point in time. Nevertheless, the petitioner is now directed to submit a fresh application, along with a xerox copy of the earlier application to the 3rd respondent, within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the said application, the 3rd respondent shall forward it to the 2nd respondent, who shall thereafter consider the same and pass appropriate orders within a period of 12 weeks from the date of such receipt.

5. With this directions, this Writ Petition is disposed of . No costs.
