ORDER

This Criminal Original Petition is filed seeking to withdraw the Crime No.1036 of 2020 dated 06.10.2020 on the file of the fifth respondent and transfer the investigation to any other investigation agency particularly the third respondent.

2. The case of the petitioner is that she is the wife of the deceased namely Arjunan and he gave a sum of Rs.10,00,000/- to the concerned Advocate to settle the loan amount, obtained from Muthoot 1/3

Finance, Madurai Branch. But the Advocate did not pay the amount and the amount was not settled. Hence, the above said crime was reported and Sasikumar Advocate was shown as accused in the above said crime. Further, the above Advocate filed a petition seeking Anticipatory bail before the Principal Session Judge, Dindigul and the same was dismissed in both occasions. The fifth respondent did not take any proper steps to investigate the case and hence, the petitioner prays to transfer the investigation from the file of the fifth respondent to any other investigating officer. Hence, this petition.

The learned Additional Public Prosecutor would submit that, so far, the statements of four witnesses have been recorded and the investigation is taken in a proper manner and the fifth respondent is ready to file the final report, within time is stipulated by this Court. I find no valid reason to transfer the Investigation.

4. Recording the submission made by the learned Additional Public Prosecutor, the fifth respondent is directed to complete the investigation within a period of five months from the date of receipt of a copy of this order and file the final report before the concerned jurisdiction court.

5. With these directions, this Criminal Original Petition stands disposed of.
