Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the Respondents to promote the Petitioner to the post of Deputy Block Development Officer retrospectively from the date on which the Petitioner Juniors were promoted as Deputy Block Development Officer in the light of the order of this Honourable Court dated 26.10.2006 made in W.P. No.29408 and 29940 / 2003 and the Government Letter (Ms) No. 42/E7/Rural Development and Panchayat (E7) Department dated 12.03.2008 and further promote the Petitioner to the Post of Block Development Officer retrospectively with all attendant and service benefits.

The writ petitioner became Deputy Block Development Officer on 28.08.2008. According to the petitioner, this promotion was belatedly granted and that he should have been made Deputy Block Development Officer in the year 2006 itself when his juniors in the post of Assistant were granted such promotion. In this regard, the petitioner has given representation dated 25.06.2014. Since the petitioner has already retired from service, the first respondent must consider the said representation.

2.Therefore, the first respondent is directed to consider the said representation on merits and in accordance with law within a period of ten weeks from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
