ORDER

This Petition has been filed seeking for a direction to the second respondent not to harass the petitioner under the guise of enquiry.

2.According to the petitioner, the respondent Police is suspecting him on the ground that he gave shelter to an accused viz., Pallavarajan, the respondent Police frequently called upon the petitioner for enquiry and also harassing him. 3.Today, when the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the State, on instructions, submitted that a crime has been registered for the offence under Section 304 B of the Indian Penal Code, against one Pallavarajan and others. Now the main accused in this case is still absconding. Based on a information that the petitioner has given shelter to the accused, he has been enquired. He would further submit that the respondent Police neither harassed the petitioner nor intended to harass him.

4.Considering the above facts and circumstances of the case, the second respondent is directed to conduct the investigation and enquire into the matter, and the petitioner is directed to appear for the enquiry and also co-operate with the respondent Police. However, during enquiry, there shall not be any harassment by the respondent Police to the petitioner herein.

5.With the above observations, the Criminal Original Petition stands disposed of.
