Crime No.72 of 2019 : Respondent Prayer: Petition is filed under Section 482 of the Criminal Procedure Code praying to direct the respondent Police or their subordinates not to harass the petitioner in the guise of investigation in respect of Crime No.72 of 2019, on the file of the respondent Police.

O R D E R

This petition has been filed seeking for a direction to the respondent Police or their subordinates not to harass the petitioner under the guise of investigation in respect of Crime No.72 of 2019, on the file of the respondent Police. 2.The grievance of the petitioner is that, one Jeyakodi of Mayiladumparai Village has committed suicide. The petitioner herein is working as a Deputy Manager of Axis Bank, Rural Lending Collections Branch, Theni. The deceased Jeyakodi obtained loan from the said bank and he did not repay the amount and committed suicide. Therefore, the deceased's son viz., Malaisamy lodged a complaint before the respondent Police stating that in view of the nonpayment of the loan amount, his father got depression and committed suicide. Hence, the respondent Police registered a case in Crime No.72 of 2019 under Section 174 Cr.P.C. During the enquiry, the respondent Police called upon the petitioner for enquiry and also harassing him.

3.Today, when the matter was taken up for hearing, Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor appearing for the respondent on instructions would submit that based on the https://hcservices.ecourts.gov.in/hcservices/

complaint given by the deceased's son, enquiry has been conducted and the same is pending before the respondent Police and summon was also issued to the petitioner to produce all the relevant records relating to the loan obtained by the deceased. Instead of producing the same, the petitioner has filed this present petition. 4.Considering the fact and circumstances of the case, the petitioner is directed to appear for enquiry and produce all the materials available with him related to the loan transaction of the deceased before the respondent Police. During the enquiry, there shall not be any harassment by the respondent Police to the petitioner herein.

5.This Criminal Original Petition stands disposed of with the above directions.
