ORDER

The relief sought for in the present writ petition is to direct the respondent to dispose of the disciplinary action initiated against the petitioner in R.C.A4/3567/2020 dated 24.08.2020 by the Assistant Director of Survey and Land Records, Madurai, by passing appropriate orders.

2.The petitioner is working as Land Records Draftsman in the Taluk Office, Madurai South, Madurai. Disciplinary actions were initiated against the writ petitioner by the Assistant Director of Survey and Land Records. The petitioner defended his case and the Enquiry Officer submitted his report on 03.09.2021. A copy of the report was furnished to the writ petitioner and the writ petitioner submitted his objection on the enquiry report on 08.09.2020. However no final order has been passed in the departmental disciplinary proceedings. Thus, the petitioner is constrained to move the present writ petition.

W.P.(MD) No.8398 of 2022 3.The learned counsel for the petitioner contented that long pendency of the disciplinary proceedings would cause prejudice to the service rights of the writ petitioner, as the pendency of the disciplinary proceedings is a bar for promotion. It is contented that the petitioner is due for promotion and further delay would cause irreparable loss.

4.In view of the facts and circumstances, the respondent is directed to pass final orders on the departmental disciplinary proceedings initiated against the writ petitioner, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5.With the above direction, this Writ Petition is disposed of. No costs.
