PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing Respondent No.2 to consider the representation of the Petitioners dated 14.12.2025 in respect of their Membership in 3rd Respondent Association as their dismissal of Petitioners were illegal and against the provisions of Tamil Nadu Societies Registration Act 1975 and Association Bye-laws within a time frame fixed by this Honble Court and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice. ORDER
The present writ petition has been filed to direct the 2nd respondent to consider the petitioner's representation dated 14.12.2025.
2. Heard Mr.S.Manohar, learned counsel for the petitioner, Mr.A.Baskaran, learned Additional Government Pleader, who takes notice on behalf of the respondents 1 and 2 and Mr.B.Karunanithi, learned counsel, who takes notice for R3.

3. This Court perused the representation of the petitioners dated 14.12.2025. Relevant portion of the said representation reads as follows:- "In the circumstances stated above we want to raise the issue of the illegality of the AGM conducted without quorum and request your goodself to declare that the AGM proceedings are null and void and also declare that the removal proceedings are devoid of any merits.
We further request you that the present set of office bearers should be removed from their posts for their illegal actions and for giving false statements before a Public authority."
4. The learned Additional Government Pleader for the respondents 1 and 2 would submit that no Form-7 yet has been submitted by the office bearers.
5. The learned counsel appearing for the 3rd respondent would submit that the petitioner's removal was made in accordance with law.
6. By reply, the learned counsel for the petitioner would submit that they are further proceeding with the conduct of the meeting also. 3/6
7. With reference to the issue, it has already been settled that the 2nd respondent shall have the power of enquiry only insofar as it relates to the filing of a Form-7 or any other prescribed forms before the 2nd respondent. With respect to the validity of the Annual General Body Meeting, or the removal or conduct of fresh removal it is for the parties to approach the Competent Civil Court.
8. Accordingly, while keeping open the liberty of the petitioner to approach the Competent Civil Court and seek any emergent relief before the same, the writ petition stands disposed of. No costs.
