Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the respondents 1 to 4.
2. Issuance of notice to the respondents 5 to 9 is dispensed with.
3. The writ petitioner is a resident of Merpanaikadu Village. According to him, there are encroachments in the petition mentioned survey numbers. He wants the same to be removed.
4. When the matter was taken up for hearing, the learned Special Government Pleader pointed out that out of the three survey 2/5
3 W.P.(MD)NO.7549 OF 2026 numbers pertaining to Neivathali village, survey No.151 has been classified as tank in " A " Register. He also admits that survey No.107 of Merpanaikadu Village is also a water body. Hence, even though the relief is sought in respect of four survey numbers, we confine the scope of the direction to two survey numbers alone, namely, survey No.151 of Neivathali Village and survey No.107 of Merpanaikadu Village. It is stated that it is the fourth respondent who is the authority competent to take action to remove the encroachments.
5. The fourth respondent is directed to issue notice to the private respondents and other encroachers if any, conduct survey and if encroachments are noticed, then by adhering to due process of law, the encroachments shall be removed. The entire exercise will be completed within a period of five months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs.
