Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS directing the Respondents to issue a patta for the petitioner's land in Town Survey No. 340, Block No.7, old Ward No.5, New Ward No.10, Trichy Town Municipal, Sinthamani Village, Kaspa Mahanam, Trichy District having an extent of 1 Acre 61 cents. Based on the recent Town survey Documents Ward F, Block14, Town Survey No. 18/1 and 19 for the survey within the time frame that may be stipulated by this Court.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents to issue a patta for the petitioner's land in Town Survey No. 340, Block No.7, old Ward No.5, New Ward No.10, Trichy Town Municipal, Sinthamani Village, Kaspa Mahanam, Trichy District having an extent of 1 Acre 61 cents. Based on the recent Town survey Documents Ward F, Block14, Town Survey No. 18/1 and 19 for the survey within the time frame that may be stipulated by this Court.

2.Originally, the petitioner's husband, namely Ganapathi Subramanian purchased the property through registered sale deeds through various documents in Doc.Nos. 874/1944, 3208/1944, 3376/1944, 120/1945, 121/1945, 471/1945, 162/1946 and 217/1946. Thereafter, he was in possession and enjoyment of the property. In the meanwhile, the local body was taking steps to put up some construction in the

petitioner's property. Hence, the petitioner's husband had filed O.S.No.172 for 1959 on the file of the District Munsif Court, Trichirappalli and the same was decreed in the petitioner's favor and the local body has not preferred any appeal. Hence, the litigation ended and attained finality. The petitioner's husband died on 22/07/1963. Based on the legal heir certificate in proceedings No.K.Dis.17644/1963, the petitioner became the absolute owner of the property. Thereafter, the petitioner was in possession and enjoyment of the property.

3.The petitioner submitted an application on 05.06.2004 for issuance of patta and the official respondents have taken the same on file and issued summons. But subsequently, the respondents failed to issue any patta. In the meanwhile, due to old age, the petitioner had settled at Chennai along with the petitioner's sister. Now, the petitioner is not having any other legal heirs and is intending to settle the property as per her wish. In the meanwhile, the petitioner has also lost the original documents for which the petitioner had submitted a complaint and the Inspector of Police had issued a non traceable certificate dated 24/06/2019. Thereafter, the petitioner has executed a General Power of Attorney thereby appointed one G.Adhi Moolam and J.Viswanathan as power agents in registered document No.79 of 2025, dated 07.08.2025. In such circumstances, the petitioner sought to survey and demarcate the property and issue patta. The prayer of the petitioner to survey and demarcate the property has already been carried out by the 5th respondent based on the order passed

in W.P.(MD)No.5542 of 2026. Now, the petitioner is seeking to issue patta. 4.Therefore, the 2nd respondent is directed to consider the petitioner's claim and issue patta, if all the other documents are proper. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order. 5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
