Suyambulinga Bharathi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. not known of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who is the sole accused, apprehending arrest at the hands of the respondent police for the offences punishable under sections 467, 468, 477 and 420 of IPC, in Crime No. Not Known of 2020 on the file of the respondent police, seeks anticipatory bail. 2.Earlier, this Court by order dated 29.07.2020 directed the petitioner to appear for enquiry before the respondent police and cooperate with the enquiry.
3.When the matter is taken up for hearing today, the learned counsel appearing for the petitioner submitted that due to lock down owing to COVID-19 pandemic situation, the petitioner was not able to appear before the respondent police and hence, he seeks time. CRL OP(MD). No.7885 of 2020 for the respondent Police submitted that petition enquiry is pending against the petitioners 4.Considering the submissions made on either side, the respondent Police is directed to complete the enquiry, within a period of two weeks from the date of receipt of a copy of this order and if any prima facie case is made out against the petitioner, the respondent police shall register the First Information Report or close the petition enquiry. Further, the petitioner is directed to appear before the respondent Police and co-operate with the enquiry. Till then, the respondent police is directed not to arrest the petitioner.
