For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.114 of 2019 on the file of the respondent Police.

ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC r/w Section 21(1) of Tamilnadu Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.114 of 2019, seeks anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioner has submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that even as per the FIR, the petitioner has transported one unit of sand illegally. The petitioner is not having any bad antecedent and hence, he prayed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4.Per contra, the learned Additional Public Prosecutor appearing for the respondent has submitted that the petitioner/Accused No.1 is having two previous cases similar in nature. Hence, he opposed this petition.

5.Considering the aforesaid submission made by the learned Additional Public Prosecutor that the petitioner/Accused No.1 is having two previous cases similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this criminal original petition is dismissed.
