The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 80 days in filing appeal, challenging the award, dated 23.09.2024 made in M.C.O.P.No.1192 of 2019 on the file of the Motor Accident Claims Tribunal, Special Sub Court, to deal with MCOP cases, Tirunelveli.

2.Heard the learned counsel for the petitioner as well as the learned counsel for the respondents 1 and 4 and also perused the records. 3.The learned counsel for the petitioner would submit that they have already deposited the entire award amount before the trial Court. He would further submit that since the respondents 2 and 3 remained ex-parte before the trail Court and hence, notice may be dispensed with and also filed memos to that effect.

4.The said memos are recorded.

5.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter on 26.03.2026. das 23.03.2026 https://www.mhc.tn.gov.in/judis
