ORDER

The writ petition has been filed for a Mandamus, directing the first respondent to dispose of the complaint dated 18.11.2024 to take action against the second respondent and award compensation to the petitioner.

2.The petitioner states that on account of the negligence of the second respondent, the petitioner had undergone treatment at DADG Tirunelveli Medical College Hospital. This resulted in removal of her uterus. She states that it is only on account of the negligent manner, in which the second respondent had conducted an abortion on 10.09.2024 and 11.09.2024. It resulted a hole in her abdomen and consequent damage to her uterus.

3.Mr.B.Ramanathan representing Mr.V.Ramesh states that the complaint of the petitioner was taken on file and both the parties were enquired on 03.02.2025. The first respondent has decided to refer the matter to an expert in the field to get a report as to whether the action of the second respondent is a result of negligence before proceeding further. He states that the entire proceedings will be completed within a period of 8 weeks.

4.The statement of Mr.B.Ramanathan is recorded. Being a statutory function of the first respondent, the proceedings shall be completed and the result be informed to the petitioner within a period of 12 weeks from today.

5.With the aforesaid directions, the Writ Petition stands disposed of. No costs.
