Prayer: This Writ Petition has been filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondent to pass suitable orders to make necessary correction in the Birth Register to effect the above correction in the Birth Register under Section 15 of the Registration of Births and Deaths Act 1969 read with Rule 11 of the Tamil Nadu Registration of Birth and Death Rules, 2000 by considering the petitioner's representation, dated 11.07.2015 within the period stipulated by this Court.

ORDER

The Writ Petition has been filed praying for a Writ of Mandamus directing the respondent to pass suitable orders to make necessary correction in the Birth Register of the petitioner's son under Section 15 of the Registration of Births and Deaths Act 1969 read with Rule 11 of the Tamil Nadu Registration of Birth and Death Rules, 2000 by considering the petitioner's representation, dated 11.07.2015, within a stipulated time.

2. Mr.J.Lawrance, learned counsel takes notice for the respondent.

3. By consent, the Writ Petition itself is taken up for final disposal.

4. The case of the petitioner is that his second son was born on 24.03.1994 in St. Joseph Hospital, Dindigul. While giving

details to register the birth of his second son, the petitioner's father-in-law had wrongly given the names of the petitioner, his wife and his son. The name of the petitioner was recorded as "Haffiesdeen" instead of K.Mohammed Haffizuddin. Likewise, the name of the petitioner's wife was recorded as "Aysha Banu" instead of "H.Asha Banu" and his son name was recorded as "H.Mohamed Sulthan Alaudeen" instead of "M.Mohamed Sulthan Alavudin". Hence, the petitioner has made a representation to the respondent on 11.07.2015 to correct the names in the birth certificate of his son. Since the said representation was not considered so far, the petitioner has come forward with the present Writ Petition for the above stated relief.

Considering the submissions made by the learned counsel for the petitioner, without going into the merits of the averments made in the Writ Petition, this Court directs the respondent to consider the representation of the petitioner, dated 11.07.2015 and pass appropriate order by conducting enquiry, within a period of six weeks from the date of receipt of a copy of this order. The petitioner is also directed to give all necessary documents to the respondent to pass necessary orders.

With the above direction, the Writ Petition is disposed of. No Costs.
