Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to survey and fix boundaries in respect of the properties situated in Survey Nos. 123/2A3 123/5A and 123/2A1C2 totally to an extent of 3 acres 60 cents at Seelayampatti Village, Theni Taluk, Theni District as per the provision contemplated under Section 9 and 10 of the Tamilnadu Survey and Boundaries Act on the basis of the representation dated 09.01.2025 within a stipulated time fixed by this Court. ORDER
With the consent of the learned counsel appearing on either side, the writ petition is taken up for final disposal, at the admission stage.
2. The petitioner seeks disposal of her survey application by issuance of a Writ of Mandamus.
3.I have heard Mr.E.Satheesh, the learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents.
4.The learned counsel for the petitioner would submit that the petitioner's application is based on the registered sale deed and also patta mutated in her name. But still the respondents have not come forward to conduct survey despite almost three months having passed.
5. Considering the above, it would suffice to dispose of the writ petition directing the respondents to conduct survey based on the petitioner's application dated 09.01.2025 after putting on notice if any interested adjoining neighbouring owners. The said exercise shall be 2/4
completed within a period of four weeks from the date of receipt of a copy of this order.
6. With the above direction, the writ petition is disposed of. No costs.
