PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 1st and 2nd respondents to give police protection to the petitioners for the peaceful possession of the petitioners land situated in Survey Nos.57/1 and 58/1 having an extent of 4.34 acres situated at Osarapalli Village, Thuraiyur Taluk, Tiruchirappalli District till the disposal of the main Civil Revision Petition Revision Petition in C.R.P.(MD) No.388 of 2021 on the file of this Hon'ble Court.

ORDER

This petition has been filed seeking direction to direct the first and second respondents to give police protection to the petitioners for the peaceful possession of the petitioners land situated in Survey Nos.57/1 and 58/1 having an extent of 4.34 acres situated at Osarapalli Village, Thuraiyur Taluk, Tiruchirappalli District till the disposal of the main Civil Revision Petition Revision Petition in C.R.P.(MD) No.388 of 2021 on the file of this Court.

2.It seems that there is a civil dispute pending between the petitioner and the third respondent in respect of a property comprised in Survey Nos.57/1 and 58/1 having an extent of 4.34 acres situated at Osarapalli Village, Thuraiyur Taluk, Tiruchirappalli District, therefore they have also filed a Civil Revision Petition https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.8024 of 2022 before this Court in CRP(MD) No.388 of 2021 and it is also pending, therefore police protection sought for cannot be considered.

3. In view of the same, the Criminal Original Petition stands dismissed. However the petitioner is at liberty to approach the civil Court for appropriate relief.
