The petitioner, who apprehends arrest at the hands of the respondent for the offence punishable under Section 318(4) of BNS Act, in Crime No.125 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that deceased is the son-in-law of the defacto complainant and the friend of the petitioner. The deceased died due to heart attack on 15.11.2023. When the defacto complainant was checking the phone of the deceased, he came to know that an amount of Rs.12,46,501/- was paid to the account of the petitioner through G-pay and on enquiry, one Devasakayam informed that he only introduced the deceased to the petitioner with regard to taking a lease of the engineering college at Nagercoil. When he contacted the petitioner, he replied that someone else took lease of the said college and hence, he promised to return the said amount within one month. Even though, repeated demands were made, he failed to repay the amount. Hence, this case.
3. The learned counsel for the petitioners would submit that the petitioner is an innocent and he was falsely implicated in this case and he 2/6
has no way connected in the above said incident. He would further submit that already he paid a sum of Rs.5 lakhs. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) would submit that the petitioner cheated the tune of Rs.12,46,501/-. Hence, he strongly opposed to grant anticipatory bail to the petitioner. He would further submit that the investigation is still pending and the petitioner already paid a sum of Rs.5 lakhs.
5. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side and the nature of offences charged against the petitioner, and there was a money dispute between the petitioner and the son-in-law of the defacto complainant and even according to the prosecution, already the petitioner paid a sum of Rs.5 lakhs to the defacto complainant, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions: [a] Accordingly, the petitioner is ordered to be 3/6
released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Rajapalayam, and on further conditions that:
[b] the petitioner shall report before the respondent police, every Monday at 10.30 a.m for a period of 8 weeks and thereafter, as and when required for interrogation; [c] the petitioner shall not commit any offences of similar nature.
[d] the petitioner shall not abscond either during investigation or trial.
[e] the petitioner shall not tamper with evidence or witness either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in 4/6
