ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 5 and 6 to cancel the sale deed dated 08.03.2024 on the file of the 6th respondent under Document No.864 of 2024 in relation to the land in S.No.64/1A1 situated at Ranganathapuram North Village, Krishnarayapuram Taluk, Karur District, pending disposal of the suit in O.S.No. 226 of 2021 on the file of the District Munsif Court, Krishnarayapuram. 2.The contention of the petitioner is that the 7th respondent has wrongly claimed as wife of Late.Subramani and has obtained legal heir certificate fraudulently. The 7th respondent is further trying to encumber the property. Therefore, the said fraudulent act ought to be enquired by the official respondents. 2/5
3. After hearing the submissions of both sides, this Court is of the considered opinion that the official respondents' power under Section 77A is stuck down by the Honourable Supreme Court. Therefore, the official respondents cannot conduct any enquiry. The appropriate remedy for the petitioner is to approach the Civil Court. Hence, this writ petition is dismissed. The petitioner is at liberty to approach the competent Civil Court. There shall be no order as to costs.
