PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to call for the records relating to the impugned order in M.C.No. (A3)93/2026/672/26 dated 16.02.2026 passed by the 1st respondent quash the same and allow this petition.

ORDER

The present petition has been filed challenging a summon issued under Section 129 of BNSS on the ground that the ingredients under Section 130 have not been satisfied.

2. The learned Government Advocate(crl.side) appearing for the respondents submitted that only the summon has been issued under Section 129 of BNSS. In case if the authorities are satisfied that Section 130 of BNSS has to be invoked, a separate show cause notice fulfilling all the ingredients of Section 130 of BNSS, would be issued before passing an order under Section 130 of BNSS.
