ORDER

This petition has been filed to direct the second respondent and their officials not to harass the petitioner unnecessarily against law under the guise of enquiry on the basis of the petitioner's representation dated 09.04.2021. 2.The learned counsel appearing for the petitioner submitted that on the basis of complaint given by the defacto complainant, the second respondent called the petitioner for enquiry continuously and harassed him. In this regard, the petitioner sent a representation, dated 09.04.2021 to the respondents. However, no action has been taken. Hence, the petitioner filed the present petition seeking the aforesaid relief.

Crl.O.P.(MD)No.7124 of 2021 3.Heard the learned counsel appearing on either side. 4.Whatever might be the circumstances, the second respondent police is directed to consider the representation of the petitioner dated 09.04.2021 by following the principles laid down by the Hon'ble Apex Court in D.K.Basu Vs. State of West Bengal reported in AIR (1997) SC 610.

5.With the above direction, this Criminal Original Petition is disposed of.
