PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the first Respondent to take necessary action to impound the passport of third accused by name Suruli @ Surulirajan in Crime No.177 of 2012 on the file of the 2nd Respondent and to produce the third Accused by name Suruli @ Surulirajan as per law within a stipulated time. ORDER

This petition has been filed for a direction to the respondent police, to take necessary action in order to secure the third accused in the case pending in Crime No.177 of 2012. 2.Heard learned counsel for the petitioner and learned Government Advocate (Crl.Side) for the respondents. 3.The learned counsel for the petitioner would submit that the third accused has gone to Singapore and he has not come back to India. The petitioner had taken steps through the Indian High Commission in Singapore, to secure the presence of the third accused. The Singapore police by the letter dated 15.10.2015 had informed the petitioner that necessary assistance will be given, if the authorities in India choose to approach through proper channel.

4.The second respondent is directed to immediately take steps through the Commissioner of Police, Madurai to issue lookout circular as against the third accused. The second respondent shall also write a formal letter to the Singapore Police, seeking the custody of A3 in Crime No.177 of 2012.

5.The second respondent is directed to take all the above steps as expeditiously as possible. The petitioner shall also cooperate with the second respondent in order to secure the third accused and bring him back to India.

6.The second respondent police after securing the third accused, shall proceed to complete the investigation within a period of three months and thereafter file a final report. 7.With the above directions, this Criminal Original Petition is disposed of.
