PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to give necessary Police Protection to the Arulmigu Santhana Mariamman Temple Panguni Pongal festival held on 08.04.2025, 09.04.2025, and 10.04.2025, at E.Perumalpatti, Ezhumalai Post, Peraiyur Taluk, Madurai District on the basis of the petitioner representation, dated 11.03.2025 within a time frame as fixed by this Court.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents 1 to 4 to give necessary Police Protection to the Arulmigu Santhana Mariamman Temple Panguni Pongal festival held on 2/6

08.04.2025, 09.04.2025, and 10.04.2025, at E.Perumalpatti, Ezhumalai Post, Peraiyur Taluk, Madurai District on the basis of the petitioner representation, dated 11.03.2025 within a time frame as fixed by this Court.

2.According to the petitioner, the petitioner and the other villagers decided to conduct festival for the Arulmigu Santhana Mariamman Temple in the event of Panguni festival from 08.04.2025 to 10.04.2025, thereby, they sought for police protection from the fourth respondent through representation dated 11.03.2025, but the same has not been considered. Hence this petition.

3.The learned Government Advocate appearing for the respondents 2 and 3 would submit that based on the reference made by the fourth respondent they conducted peace committee meeting. As per the peace committee meeting, already the other party conducted festival and now the petitioner's party want to conduct the festival, for which, the other party have no objection. Therefore, the police protection can be granted by the fourth respondent.

4.The learned Additional Public Prosecutor appearing for the respondent police would submit that there are two rival groups claiming rights over the temple and thereby, the matter was referred to the third respondent for peace committee and they also conducted peace committee meeting as per the peace committee meeting, both the parties agreed to conduct the festival separately. Already, the other party conducted festival and now the petitioner's party want to conduct the festival. Therefore, the petitioner's representation will be considered favorable and positively.

5.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondent, is inclined to pass order.

6.Since the matter has been amicably settled between the parties and already the other party conducted festival and now the petitioner's party want to conduct the festival, for which the other party have no objection, the fourth respondent is directed to consider the petitioner's representation positively and grant police protection for the said festival in accordance with law.
