O R D E R

This Writ Petition has been filed seeking a direction to the first respondent herein to take appropriate steps to cancel the registered Gift Deed dated 20.09.2006 (Document No.2089 of 2006) on the file of the Manachanallur Sub-Registrar Office, in the light of the petitioner's representation dated 07.02.2023, within a stipulated time to be fixed by this Court.

It is the case of the petitioner that the property situated at Trichy District, Manachanallur Taluk, Koothur Village, S.F.No.73/10C, admeasuring 0.46 acres, belongs to the petitioner by virtue of a Sale Deed dated 10.12.2004. The petitioner formed a house site lay-out in the above said lands and the third respondent granted 'No Objection Certificate' for the said lay-out. On 20.09.2006, the petitioner executed a registered Gift Deed in favour of the third respondent as well as the Commissioner, Manachanallur Panchayat, pertaining to the public areas 2/6

situated in the above said lay-out. The said Gift Deed was duly registered before the Manachanallur Sub-Registrar as Document No.2089 of 2006. Subsequently, the recognition granted by the third respondent was cancelled and, therefore, the Gift Deed executed by the petitioner in favour of the third respondent is liable to be cancelled. 2.(i). The petitioner approached the respondents in this regard on various occasions. However, no steps were taken to cancel the said Gift Deed dated 20.09.2006. Thereafter, the petitioner submitted a detailed representation dated 07.02.2023 before the respondents. Even thereafter, no action has been taken till date. Hence, the present Writ Petition has been filed.

3. The learned Special Government Pleader appearing for respondents submitted that the petitioner's representation dated 07.02.2023 will be considered in accordance with law.

4. Considering the limited relief sought for by the petitioner, a direction is issued to the second respondent to dispose of the petitioner's representation dated 07.02.2023, on its own merits, and pass appropriate 3/6

orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order, after giving due notice to the petitioner as well as the rival parties and after affording them an opportunity of hearing. It is made clear that this Court has not expressed any opinion on the merits of the case and it is open to the second respondent to consider the same independently.

5. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
