ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.D.MALAICHAMY, Advocate for the petitioner and the Respondent not appeared either in person or by an Advocate, the court made the following order:- (Order of the Court was made by K.RAVICHANDRABAABU,J) This application is filed seeking to condone the delay of 307 days in filing the above Civil Miscellaneous Appeal. https://hcservices.ecourts.gov.in/hcservices/ 2.The Insurance Company is the appellant. Though notice was ordered to the respondents and the same was served on them, they
have not chosen to appear before this Court either in person or through their counsel. Their names are also printed in the causelist. 3.Considering the length of delay in filing the above Civil Miscellaneous Appeal and also considering the reasons stated in the accompanying affidavit, We are inclined to allow this application, however, subject to the condition that the Petitioner / appellant / Insurance Company pays a sum of Rs.1,000/-(Rupees one thousand only) towards cost, to the credit of Chief Justice Relief Fund of this Court, within a period of seven days from the date of receipt of a copy of this order, failing which, this application shall stand automatically dismissed, without further reference to this Court. sd/- 19/07/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
