Respondents Prayer : Criminal Original Petition filed under Section 528 of BNSS to direct the 4th and 5th respondents to implicate Dhayalan, Ramachandran and Venkateswaran of Astronio properties private limited, an allied concern of Neomax Group of companies as accused in Crime No. 3 of 2023 on the file of the 5th respondent and further direct them to attach their properties in the above said case by considering the list of properties, which was provided by the petitioners before the respondents 4 and 5. ORDER

This petition is filed by the petitioner to direct the respondents 4 and 5 to implicate Dhayalan, Ramachandran and Venkateswaran of Astronio Properties Private Limited, an allied concern of Neomax Group of companies as accused in Crime No. 3 of 2023 on the file of the fifth respondent and further direct them to attach their properties in the above 2/6

said case by considering the list of properties, which was provided by the petitioners before the respondents 4 and 5.

The learned counsel for the petitioners would submit that the petitioners also depositors of the Astronio Properties Private Limited, which is the sister concern of the Neomax Properties Private Limited. Thereby, the fifth respondent registered a case in Crime No.03 of 2023 against Neomax Properties Private Limited and and its allied companies. While so, the petitioners have deposited the amount by believing the words of the Team heads, namely, Dhayalan, Ramachandran and Venkatesan of Astronio Properties Private Limited, which is sister concern of the New Max Properties Private Limited. Therefore, the abovesaid persons have to be implicated as accused in this case and the properties have to be attached as per law. Therefore, the petitioners filed this petition.

The learned Government Advocate (Crl.Side) for the respondents would submit that the petitioners' lodged a complaint before the fifth respondent on 12.11.2024 and the petitioners' names also were included as victims in the case. Thereafter, no representation was received from the petitioners in respect of the list of properties and the proposed accused. 3/6

Now only, the petitioners stated that the said Dhayalan, Ramachandran and Venkatesan of Astronio Properties Private Limited are also involved in this case. Now, the case is under investigation. Therefore, they will consider the same, if the petitioners produce any records in their favour as against the above said persons and the properties. Then, they will consider the same and take appropriate action in accordance with law.

Considering the prayer sought for in this petition, recording the above said submission of the learned Government Advocate (Crl.Side), this Court directs the petitioners to approach the fifth respondent by producing the records available with them in respect of the implication of the above said persons, namely, Dhayalan, Ramachandran and Venkatesan and also the list of properties and if any such documents produced by the petitioners, the fifth respondent has to consider the same during investigation and to take appropriate action in accordance with law.

5. With the abovesaid observations and directions, this Criminal Original Petition is disposed of.
