Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorari, calling for the records relating to the impugned communication No.Nil dated 12.04.2021, regarding the assessment of property tax for the door number situated in Survey No.28/2D2, Anaiyur Village, Sivakasi Taluk, Virudhunagar District passed by the second respondent and quash the same as arbitrary.

*********** By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.Heard Mr.G.Mariappan, learned Counsel appearing for the petitioner and Mrs.S.Srimathy, learned Special Government Pleader appearing for the respondents 1 and 2.

3.The impugned order is in the nature of a show cause notice, calling upon the petitioner to give his explanation with regard to https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.[MD]No.9262 of 2021 the proposal of the respondents to cancel the property tax assessment.

4.It is a settled proposition that the Writ Court, exercising its powers under Article 226 of the Constitution of India, will not normally interfere with the show cause notice, unless under very few exceptions. The learned Counsel for the petitioner would submit that he is willing to give his explanations to the impugned notice dated 12.04.2021.

5.In view of the submissions made, the petitioner herein is granted liberty to treat the impugned order dated 12.04.2021 as show cause notice and give his explanation to the second respondent herein within a period of fifteen [15] days from the date of receipt of a copy of this order.

6. This Writ Petition stands disposed of, accordingly. However, there shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
