ORDER : The Court Made the following order :- The petitioner is in judicial custody since 08.07.2018 for the offences punishable under Section 174 of Cr.P.C. @ 306 of IPC in Crime No.352 of 2018 on the file of the respondent police. He seeks bail.

2.The case of the prosecution is that the deceased is the minor and fell in love with the petitioner. The petitioner is a married man. Therefore, on 06.07.2018, A-2 and A-3 scolded the deceased using filthy languages and also assaulted her. Therefore, she committed suicide by hanging herself. Hence, the complaint. 3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 4.The learned counsel for the petitioner would submit that the petitioner is a married man and he is nothing to do with the crime. Even as per the allegations in the First Information Report, A-2 and A-3, at about 1.30 p.m. on 06.07.2018 scolded the deceased using filthy languages and assaulted her. Therefore, she committed suicide by hanging herself. Hence, he prays for grant of bail to the petitioner.

5.It is seen from the First Information Report that the occurrence took place on 06.07.2018 at about 1.30 p.m. When the deceased was going for her lunch, A-2 and A-3 scolded her and also https://hcservices.ecourts.gov.in/hcservices/

assaulted her, therefore she committed suicide by hanging herself. Considering the facts and circumstances of the case, as per the suffice the petitioner is concerned except fell in love with the deceased he is nothing to do with the crime and also considering the period of incarceration of the petitioner, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions: (i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Dindigul.

(ii)the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders;
