O R D E R
The writ petition has been filed for a writ of mandamus, directing the second respondent to cancel the assessment in Nos.15819, 16246 in favour of the respondents Nos.3 & 4 and consequently to restore the name of the petitioner's grandfather viz., Ramasamy in furtherance of the proceedings of the second respondent in Na.Ka.No.2288/2013/C2, dated 22.07.2013. 2.According to the petitioner, the property in question originally belonged to his grand father. After death of his grand father, his children including petitioner's father and respondents https://hcservices.ecourts.gov.in/hcservices/
3 and 4 were inherited the same along with others. Behind the back of the petitioner, the respondents 3 & 4 got the assessment order changed in their name. Hence, the petitioner gave a representation to the second respondent on 28.02.2013 to cancel the same. The second respondent issued notice in Na.Ka.No.2288/2013/C2, dated 22.07.2013 for enquiry. Subsequently, enquiry was not proceeded with. Hence, the petitioner has come out with the present writ petition.
3.From the records, it is seen that the second respondent issued notice for enquiry based on the complaint given by the petitioner and the enquiry was not conducted. 4.In view of the same, the second respondent is directed to proceed with the enquiry and pass orders on the same after giving notice to the petitioner and the respondents 3 and 4, within a period of twelve weeks from the date of receipt of a copy of this order.
5.With the above direction, the writ petition is disposed of. No costs.
